The Joint Parliamentary Constitution Review and Implementation Oversight Committee (OC) invite applicants who are citizens of Somalia for the following consultancy position:
- Organization and Project Description
Today, Somalia is undergoing a transition that represents the best chance for peace and state-building. With the objective to consolidate and accelerate this transition, and in line with the SDGs and the National Development Plan, the global objective of the project is to foster Inclusive Politics through the strengthening of the effectiveness and accountability of Somalia’s parliamentary institutions to be more responsive to the needs of citizens in promoting participation in political processes contributing to national peace building, state-building and development goals. Therefore, aiming at fostering political representation and stimulate a lively civil society, to prepare the 2024 multiparty reform and at supporting the finalization of the Constitution and the federation process, the project focuses on the four key pillars of democratic governance that play an important role in the development of Somalia’s Inclusive Politics – National Federal Parliaments, Federal Member State Parliaments and Civil Society, – through an integrated approach that is in line with a fourth component, of achieving progress towards SDG in Somalia.
Provisional Constitution establishes the Oversight Committee and each house of the Somali Federal Parliament elected 5 members of Constitution Review and Implementation Oversight Committee and each Federal Member State of the Federal Republic of Somalia nominated one Federal Member State Delegate. The Oversight Committee is key institution to oversee and guide the constitution review process. Its establishment and duties are regulated in the law and in accordance with Art. 133 and Art. 134 of the Provisional Constitution

The OC is looking to recruit a senior legal advisor to provide responsive support to the activities of the Oversight Committee.
3. Scope of Work
The overall responsibility of the constitutional law expert is to support the Oversight Committee performs its mandate and undertakes the work assignments outlined in the Joint Roadmap of the constitutional review process
The scope of work will include:
- Provide support to the Oversight Committee on the review of the Constitutional Review Process and assist the OC in their interactions with the other inter-regional consultative forums.
- Support OC to familiarize with three options regarding the constitution review process developed by 11th
- Support OC to design the priorities of the areas of the constitution review process to submit to the Somali Federal Parliament.
- Enhance the capacities of OC members and train young graduates on issues related to the constitutional-making process.
- Provide guidance to the OC in the implementation of the road map of the constitutional review process and support attending immediately to any amendment of the articles of the constitution as required.
- Assist OC with comparative analysis of the results of the public consultations in the Federal Member States.
- Provide technical assistance to OC Forum in the implementation of the activities related to Constitutional Review process.
- Assist OC in preparations of Draft Constitutional Amendments based on the results of the Public Consultations in the Federal Member States,
- Support OC to familiarize with options regarding articles that need political negotiations between the federal Government and Federal Member States;
- Assist OC in the preparation of Final Draft Constitutional Amendments based on the results of the Political Consultations between the Federal Government and the Federal Member States;
- Perform such other duties of a constitutional character, as may arise from time to time be referred or assigned to him by OC.
- Reports to be provided:
- Monthly progress report for completed activities and deliverables with documents developed, training materials, strategic documents, and work plans and workshop reports.
- Final Progress Report.
- Institutional Arrangement:
Achievement of Deliverables will be approved by the supervisor of the consultant. Payment will be made upon certification by supervisor of time sheets for actual dates of work and consultant performance in accordance with activities and deliverables as reported in the Activity Report
- Required Skills and Experience
Education:
- Master’s degree in law, legislative studies, related fields,
- Knowledge in Somali legal system
- Experience:
- Minimum 6 years of technical and legal expertise, at least 3 years of experience as lawyer, judge, prosecutor or law professor.
- Working experience in conflict or post-conflict countries required for the conduct of the exercise itself, and for understanding the particular context of the evaluation.
- Broad knowledge and understanding of the major economic and social development issues and problems in Somalia.
- Displays culture, gender, religion, race, nationality and age sensitivity and adaptability.
- Language:
- Fluency in English and Somali languages.
- Competencies and Skills
- Extensive knowledge of and experience in the Somalia constitutional history, Provisional Constitution as well as the overall mandate of the OC and other organs of Constitutional Review.
- Teamwork skills or proven skills in working as part of a team.
- Proven expertise in Somali law with legislative drafting experience is an advantage.
- Demonstrated experience with legal policy development and formulation.
- Experience working in the public sector is an advantage.
- Experienced at drafting reports, briefings and other materials.
