  1. Description of the post

 

The Independent Constitutional Review and Implementation Commission invites applicants who are citizens of Somalia for the following consultancy position:

The Independent Constitutional Review and Implementation Commission was established in accordance with Article 134(6) of the Provisional Constitution, Law no. 119 of 7/8/2013 and Presidential Decree No. 99 issued on 18/3/2023. The commission consists of 5 members of the Federal and one delegate from each Federal Member States.

To assist in implementing these goals, ICRIC is looking to recruit senior legal advisor to provide responsive support to the activities of the Commission.

 

  1. Scope of Work

The overall responsibilities of the legal advisor are (i) to advise legally the ICRIC on legal issues regarding implementation of the constitution review process, (ii) to provide technical and legal assistance to ICRIC to perform the assigned tasks by the constitution, and (iii) to develop and draft policy document, legal opinion, concept note and plans as assigned by the supervisor.

The scope of work will include:

  • Develop policy documents, concept notes and briefing papers regarding the constitution review process

  • Provide technical and legal support to ICRIC on matters of the constitution including constitutionality of the proposed legislations

  • Assist ICRIC to draft legislations and resolutions as required

  • Support and guide the drafting sub-committee of ICRIC to perform its activities.

  • Assist the ICRIC to design   action plan and identify priorities in the in constitution and submit to the Somali Federal Parliament.

  • Do legal research on constitutional issues as necessary and make recommendations to ICRIC for action as appropriate

  • Train the interns on research and legal drafting

  • Draft legal opinions and provide advice   on legal issues of particular complexity and importance.

  • Give invaluable legal guidance to the ICRIC in formulation of its legal document and execution of its decisions.

  • Support ICRIC to review the existing legal frameworks, especially in light of the constitutional review process

  • Prepare analytical and information documents for ICRIC as required Perform such other duties of a legal character, as may from time to time be referred or assigned to him by the ICRIC.

Reports to be provided:

 

  • Monthly report for completed activities and deliverables with documents developed, training and workshop reports.

  • Quarterly Narrative 

  • Final report. 

 

  1. Institutional Arrangement

Achievement of deliverables will be approved by the ICRIC. Payment will be made upon certification of ICRIC of time sheets for actual dates of work and consultant performance in accordance with activities and deliverables as reported in the activity report.

 

  1. Duration of the Work

 

Contract is for 3 months from July – Sep 2024

 

  1. Duty Station

 

Duty station of the consultant will be Mogadishu, Somalia with possible travels to Federal Member States.

 

  1.  Required Skills and Experience. 

Competencies and Skills

 

  • Master’s Degree in Law, Legislative Studies and related fields

  • Knowledge in Somali legal system.

Experience

 

  • Minimum 6 years of technical and legal expertise, at least 3 years of experience as lawyer, judge or prosecutor.

  • Working experience in conflict or post-conflict countries required for the conduct of the exercise itself, and for understanding the particular context of the evaluation

  • Broad knowledge and understanding of the major economic and social development issues and problems in Somalia. 

  • Displays cultural, gender, religion, race, nationality and age sensitivity and adaptability.

Language:

  • Somali and fluency in English required

 

  • Extensive knowledge of and experience in the Somalia constitutional history, Provisional Constitution as well as the overall mandate of the ICRIC and other organs of Constitutional Review;

  • Team work skills or proven skills in working as part of a team

  • Proven expertise in Somali law with legislative drafting experience is an advantage;

  • Demonstrated experience with legal policy development and formulation; 

  • Experience working in the public sector is an advantage;

  • Experienced at drafting reports, briefings and other materials;

  • Sound demonstrated understanding of gender issues and principles;
