Terms of Reference: Consultancy: for Mobile ADR Center.

1. Project Background

The University of Hargeisa, legal Aid clinic (LAC), in collaboration with International Development Law Organization (IDLO) and other consortium members, is promoting a reformed and modernized Alternative Dispute Resolution (ADR) system through the establishment and operationalization of a new ADR Centre in Somaliland under the Program ‘Strengthening the social contracts through access to justice” funded by the Government of the Netherlands (Also known as Damal Programme). The programme aims to foster the social contract in Somaliland by increasing the legitimacy of justice institutions.

The overall goal of the programme is expected to be achieved through three (3) intermediate outcomes: (1) improved access to an Alternative Dispute Resolution(ADR) mechanism and referral pathways, especially for vulnerable groups; (2) enhanced access to formal justice for vulnerable groups through holistic support to gender-based violence (GBV) survivors and affected communities; and (3) increased participation of citizens in Somaliland in accountability processes relating to the provision of security and justice. The specific mandate of each Centre is to facilitate the practice of ADR and settle claims and disputes at the community level, facilitating and increasing access to justice for the local population, particularly vulnerable categories.

The programme will firstly review the current mobile court services offered and will, thereafter, provide technical support to the MOJ for the development of a strategy for the establishment of mobile ADR centres and the provision of legal aid services to the targeted populations, putting a specific focus on pastoralist/agro-pastoralist communities. The strategy will be operationalized through an implementation plan, whose development will also be supported by the programme. The strategy will define how mobile ADR centres will operate and use environmental information to forecast and prepare for justice needs related to droughts and related conflict facilitators. This part of the activity will be promoted in partnership with the Disaster Management Agency and with the programs implemented by working to promote Disaster Risk Reduction (DRR).

About Legal Aid Clinic

The University if Hargeisa LAC is an autonomous statutory body established by the University Of Hargeisa College Of Law in 2002. The objective of the Legal Aid is to render or make available legal assistance to poor and disadvantaged persons in Somaliland as contemplated in the Constitution of the Republic of Somaliland, which guarantees every citizen to avoidable access to justice.

The legal aid clinic provides assistance to economically disadvantaged individuals within the boundaries of Somaliland. However, the legal clinic provides legal service on the matters that fall within the legal arena of criminal law civil law, human rights, and access to justice and child and women unit. Through this clinical work, students are expected to improve their skills in respect to interviewing, counseling, and mediation skills, and research writing skills.

1. Objective Of The Assignment

The overall objective of this assignment is to develop a strategy and implementation plan for the mobile ADR centers initiative.

1. Key functions and responsibilities

• To assess the extent to which the mobile ADR centers assistance interventions will met their intended objectives and contributed to the achievement and the access to. Justice in eastern regions of Somaliland;
• To systematically review the implementation modalities, capacity development efforts, knowledge management and considerations for access to justice for vulnerable groups including women and in particular survivors of gender-based violence;
• To determine the extent to which support to mobile ADR centers has contributed to awareness-raising of the formal justice system, increasing access to or decentralizing provision of justice services;
• The extent to which mobile ADR centers can contribute towards developing and strengthening short- and long-term national capacities and strategies;
• Assess the exit strategy for Damal programme’s support to the mobile ADR center given their temporary nature
• To present key findings, generate lessons learned, and provide a set of clear and forward-looking recommendations for enhancing the quality of future engagement by IDLO and its partners in supporting mobile ADR centers arrangements.

1. About the

University of Hargeisa, legal aid clinic is seeking for a short-term national consultant, who will be closely work with the legal aid clinic of Hargeisa University (LAC). The consultant will be part of the access to justice project funded by IDLO and he/she will be responsible develop a strategy and implementation plan for the mobile ADR centers initiative.

1. Period of consultancy, scope, and the payment modality.

The consultant will be based in Hargeisa and he/she will travel to project target locations including Buroa, Erigavo and lasanod. This consultancy will be a 40 working days starting the date of contract signature. The incumbent will be paid in accordance with the terms of the services contract,  upon the completion of the service.

1. Expected key deliverables:

• Three-page inception report detailing the proposed methodology and agreed work plan submitted within 5 days from the date of signing the Contract.
• Submit a recommendation report with clear strategy for the establishment of mobile alternative dispute resolution centers in Somaliland.
• Detailed implementation plan for the ADR centers recommendation report
• Weekly reports providing updates from training (such as composition of attendees, notable discussions or reflections), to be submitted to the PM every Monday morning. Reports will be a minimum of 2 pages and are to be submitted in electronically in Microsoft Word format. Sample template will be provided.
• Report on all consultation workshops carried out. This should describe the consultation process followed and outcomes.
• Submit a work completion report.

1. Knowledge, Skills & Personal Attributes.

Knowledge:

• Graduate degree in law, international relations, political science and sociology-a master’s degree is preferred
• Minimum 5 years’ experience in legal aid and access to justice work
• Knowledge of context and Somaliland legal system is an asset.

Language skills

Fluency in oral and writing for both Somali and English
