- INTRODUCTION
The Somaliland Lawyers association (SOLLA) was founded in June 2004. The association is non-political, non-profit human right and legal profession association, which unites over 95% of the Somaliland legal practitioners including legal practitioners, academic law professors, Legal advisors to Law Makers, and MDAs as well corporate legal service providers.
The association as a local network legal professionals is responsible to improve the capacity and the value of legal practitioners and their performance in service delivery, provide protection of lawyers rights subject to the constitution, monitor their service delivery as their legal duties and build their capacity with propensity of increasing synergies on access to justice, fair and independent judiciary, respect of human rights, promotion of legal education, and realization of increased civic and democracy space in the country through observance of the laws enshrined in the constitution of the Republic of Somaliland.
SOLLA was implementing partner Rule of Law programmes since 2009 with support of UNDP, currently SOLLA with support of UNDP implementing the Somaliland Joint Rule of Law programme that focused mainly on supporting the Government of Somaliland to improve its rule of law services in Hargiesa and selective population centers. Combining mobile courts, legal aid, law scholarships, and prisons and courts inspections that programme expanded legal profession, enlarged access to the formal legal system and strengthened public confidence in it, mainly in the urban areas. This programme seeks to extend the focus on the ‘difficult to reach’ rural areas as well as to promote access to justice and enhance the rights of specific, vulnerable and disadvantaged groups.
- COORDINATOR
The Coordinator will work under the supervision of the Chairperson and is specifically responsible for:
- Managing a referral service, under the supervision of the Chairperson. This will involve developing relationships and linkages between the SOLLA and:
- Key criminal justice actors including the Ministry of Justice, Attorney General, members of the Somaliland Judiciary, prosecutors, law enforcement officials, Traditional Elders, and experts in Shari’a law to ensure the SOLLA is made aware of all women who are in need to legal assistance.
- The legal profession to ensure an appropriate database of lawyers willing and able to assist female clients is developed and maintained.
- Civil society and the broader community including local and international NGOs working on women’s issues, Somaliland bar associations, African women bar associations.
- The Sexual Assault Referral Centre to arrange for free legal advice and representation for SGBV survivors should the client request it.
- Managing the SOLLA’s Legal Aid Programme under the supervision of the Chairperson. This will involve:
- Liaising with Police, Prison and Justice Personnel and other appropriate stakeholders
- Be responsible for the establishment and maintenance of detailed case files and a case database in English for lawyer cases. The database will include, but is not limited to, the details of the cases, court, type of cases, action taken and outcome
- Be responsible for submitting a monthly report in English to UNDP on the cases undertaken by the lawyer. The lawyer will submit her reports to SOLLA every month, with full report documenting and will include (a) the names and profile of legal aid clients; (b) the facts of the case for which they are standing trial and the stage of the legal proceeding; (c) a certified copy of the interlocutory and final judgment of the court where appropriate; (d) any follow-up required and recommendations for future interventions
- Ensure that the Project works within established guidelines as agreed with UNDP Judiciary Project Manager
- Ensure that the lawyer will only take on legal cases of those persons that are economically deprived and an income legibility form must be completed for every case undertaken by the lawyer
- Ensure that each lawyer will take on a minimum of 15 criminal and civil cases per month.
- Ensure that the project staff will attend biweekly legal aid meetings with UNDP staff and as per request
- Managing the SOLLA’s involvement with the Sexual and Gender Based Violance, This will involve:
- Liaising with UNDP, Police, Medical Personnel and other appropriate stakeholders;
- Arranging for free legal advice and representation for SGBV survivors should the client request it;
- Developing and maintaining a case register database in English for Baahikoob referrals. The database will include, but is not limited to, the details of the cases referred, court, type of cases, action taken and outcome;
- Submitting a monthly report in English to UNDP on the Baahikoob cases referred. The lawyers contracted must submit reports to the SOLLA every month that include:
- the number of cases they dealt with that month
- the names and profile of clients e.g. woman, IDP, young person (16-18), juvenile (1-15), refugee;
- the type of case e.g. criminal, rape, serious assault, murder etc and quote the legal provision (iv)the facts of the case and the current stage of the legal proceeding;
- location, date of case, name of lawyer/paralegal
- resolution or outcome of the case
- a certified copy of the interlocutory and final judgment of the court where appropriate;
- any follow-up required and recommendations for future interventions;
- document the source of referral in order to monitor success of various media campaigns and information meetings.
- This applies to cases conducted by the SOLLA and referred to SOLLA by other parties/NGO/local groups. In reports a clear distinction must be made between the two.
- Fundraising for the SOLLA. This will include:
- Researching and identifying potential funding opportunities;
- Developing and implementing a long-term fundraising strategy;
- Increasing the SOLLA’s profile and hence fundraising ability through the creation of strategic relationships with appropriate partners including the private sector and Somaliland Diaspora;
- Developing funding proposals;
- Developing and managing a database to record donor and potential donor contact details, and other relevant information.
- Engaging in advocacy to build awareness of SOLLA activities, and issues affecting women’s access to justice and right to equality. This will include:
- Conducting legal awareness campaigns that mobilize relevant groups and the public in support of the SOLLA’s advocacy goals;
- Law reform advocacy: This will involve conducting research on various issues as a basis for seeking the repeal and adjustment of discriminatory and/or unconstitutional laws;
- Building strategic and active partnerships with line Ministries, parliamentarians and local authorities;
- Consulting, collaborating and developing partnerships with local and international NGOs working on women’s issues;
- Developing advocacy materials to raise public awareness of issues affecting women in the justice sphere;
- Organizing public events;
- Increasing press coverage of issues affecting women including SGBV;
- Developing links with regional and international bodies working on women’s issues including other African women bar associations.
- Managing the internship programme for recent female law graduates. This will involve:
- select interns;
- Signing agreements with institutions participating in the internship programme;
- Placing interns in justice sector institutions, qualified NGOs and local government institutions;
- Overseeing the intern’s placement;
- Developing a file of potential internship sites;
- Keeping a file for each intern including intern evaluations;
- Coordinating with the relevant institutions participating in the programme and submitting relevant reports to UNDP;
- Regularly reviewing the internship programme including a review at the end of the project.
- Acting as a careers advisor for female law students and graduates. This will include:
- Advising students on career development and job search skills in order to prepare them to gain employment upon graduation;
- Assisting graduates in securing employment in the legal sector after graduation through the internship programme, mentoring on a one-to-one basis; resume assistance and developing interview skills;
- Mentoring female lawyers.
- Indentifying training needs of members and organizing training.
- Any other duties as directed by the Chairperson.
EDUCATION AND EXPERIENCE
- University degree in law, public administration, business administration, public policy, or other relevant social sciences.
- 4-7 years of relevant professional experience, ideally within a INGOs, UN and specifically UNDP, is required.
- Professional experience in capacity development and Rule of Law Programming, legal Aid and accesses to justice would be an asset. Relevant work experience in Somaliland, a good understanding of the context and networks is desirable.
LANGUAGES
- Fluency in English and Somali is required.
TECHNICAL COMPETENCIES
- Familiarity with standard program and data management methodologies, tools, processes and results-based management and monitoring and evaluation principles.
- Excellent written and verbal communication skills. Good knowledge of Microsoft Word, Excel, and PowerPoint.
- Works well with others and actively participates.
- Shares information and contributes to the overall objectives of the SOLLA, and encourages and motivates others to become involved in team activities.
- Provides constructive feedback and willingly helps others. Contributes to a fair environment that fosters collaboration and cooperation.
- Works effectively across and within Bar-Association boundaries. Proven ability to see through tasks set and deliver results.
- Ability to work under pressure with tight deadlines, flexibility, and an entrepreneurial spirit. Ability and willingness to travel to the Somaliland regions, if necessary. Keen sense of ethics, integrity, and commitment to SOLLA’s mandate.
