  1. Background

The Federal Government of Somalia (FGS) is committed to establishing the National Independent Human Rights Commission (NIHRC) in full alignment with Article 111B of the Provisional Federal Constitution and Law No. 16 of 27 June 2016, and in strict adherence to international benchmarks—particularly the Paris Principles and the GANHRI General Observations. The NIHRC will promote, protect, and monitor human rights across Somalia.

The candidate selection process requires comprehensive transparency, inclusivity, impartiality, and strict adherence to Law No. 16 as well as internationally recognized principles. To effectively meet these requirements, it is essential to establish an independent and robust mechanism for monitoring, reporting, and follow-up throughout the selection process. The Ministry of Family and Human Rights Development (MoFHRD) seeks to engage a qualified individual with demonstrated expertise in Monitoring, Evaluation, and Reporting (MER) to undertake this assignment.

This engagement aims to enhance public trust, identify potential challenges, and ensure the process aligns with international human rights standards and national aspirations.

 

  1. Objectives of the Assignment

The main objectives of this assignment are:

  • To develop and implement a robust monitoring and evaluation framework for the NIHRC candidate selection process.
  • To ensure strict compliance with Law No. 16, Paris Principles, and GANHRI General Observations.
  • To enhance accountability, transparency, and credibility of the entire candidate selection procedure through structured monitoring, detailed reporting, and timely follow-up actions.
  1. Scope of Work

The selected Consultant will undertake the following tasks:

  • Monitoring Framework Development:
    • Develop indicators, benchmarks, and checklists consistent with Law No. 16, Paris Principles, and GANHRI General Observations.
  • Design systematic monitoring tools and mechanisms to track transparency, inclusivity, and compliance at each phase.
  • Reporting Systems and Documentation:
    • Create structured templates and guidelines for periodic monitoring reports.
  • Document compliance, deviations, and any observed challenges in real-time throughout the selection process.
  • Follow-Up and Remediation Procedures:
    • Propose structured follow-up mechanisms to address gaps or non-compliance immediately.
    • Develop corrective measures and support their implementation.
  1. Methodology

The selected Consultant will utilize a participatory and consultative approach, engaging closely with key stakeholders including the MoFHRD, Temporary Selection Panel (TSP), civil society representatives, and relevant experts to ensure contextual relevance, buy-in, and sustainability of the monitoring, reporting, and follow-up systems.

  1. Expected Deliverables

The selected Consultant is expected to deliver the following:

  • Inception Report – A concise report outlining your understanding of the Terms of Reference, proposed methodology, detailed work plan, and initial Monitoring, Reporting & Follow-up (MRF) framework (due within 7 days of contract signing).
  • Monitoring & Reporting Framework – A comprehensive framework with clear benchmarks, indicators and checklists.
  • Monitoring Tools – All data-collection instruments, including guides, questionnaires and checklists.

 

  • Reporting Templates and Guidelines – Standardized report formats, user instructions and documentation procedures.
  • Follow-up Action Plans – Defined remediation processes and responsibilities for addressing identified issues.
  • Mid-term Progress Report – A status report submitted after the shortlist is forwarded to Cabinet for approval.
  • Final Comprehensive Report – A full account of the assignment period, incorporating findings, analysis, recommendations, and lessons learned, to be submitted to MoFHRD at the end of the assignment
  1. Required Qualifications and Experience

The Consultant must demonstrate:

  • Proven experience in developing monitoring and evaluation frameworks, particularly in human rights and governance contexts.
  • Expert understanding of international human rights standards, especially the Paris Principles and GANHRI General Observations.
  • Ability to conduct independent and impartial assessments
  • Experience conducting similar assignments in Somalia or similar fragile contexts.
  • Excellent analytical, reporting, and communication skills (oral and written) in English and Somali.
  • Availability of qualified personnel with relevant expertise in MER and human rights.
  • Demonstrated commitment to ethical conduct and confidentiality.

 

  1. Reporting and Coordination

The selected Consultant will report directly to the Director General of the Ministry of Family and Human Rights, or a designated focal point. Regular coordination meetings will be held as agreed upon to discuss progress, challenges, and strategic direction.

  1. Duration of Assignment

The assignment is expected to last three and half (3.5) months, in alignment with Articles 15, 16, and 17 of Law No. 16 governing the NIHRC candidate-selection timeline.

  1. Budget and Payment Schedule

Proposals should include a detailed financial proposal outlining all costs associated with the assignment, including professional fees, logistics, and any other relevant expenses.

Payments will be linked to the successful submission and acceptance of deliverables.

  1. Application Requirements and Evaluation Criteria

  • Technical proposal detailing the understanding of the assignment, proposed methodology, and work-plan— a detailed timeline for all activities and deliverables.
  • Financial proposal with a detailed budget breakdown.
  • Contact information for at least three (3) professional references for similar assignments.

Evaluation Criteria:

  • Technical expertise and relevance of proposed methodology (40%).
  • Relevant experience of the proposed team members (30%).
  • Demonstrated experience on similar assignments (20%).
  • Financial proposal and budget clarity (10%).
  1. Confidentiality

All information gathered during the assignment shall remain strictly confidential and cannot be disclosed or used by the Consultant/Firm for purposes unrelated to this assignment without prior written consent from MoFHRD.
