Background

UNODC’s work in the region of South Eastern Europe is covered by the respective UNODC Regional Programme (RP SEE). The objective of the RP SEE is to meet specific national needs articulated in an inclusive, participatory process while at the same time ensuring that activities and outputs at national level form part of a coordinated, harmonized regional and inter-regional approach in line with the principles that underlie UNODC’s activities globally, and more broadly in line with the 2030 Agenda. UNODC strives to bring its global expertise and scope to South Eastern Europe to strengthen both national and regional approaches, embedding the Regional Programme for South Eastern European national, regional, inter-regional and global contexts and creating coherence across them.

Under the Regional Programme, UNODC, as the global leader in addressing the problem of illicit drugs, transnational organized crime and terrorism, provides support to the region in the implementation of relevant treaties and instruments, including by means of supporting the development of national drug and crime policies and strategies and their implementation plans, as well as the EU requirements under chapters 23, 24 and 28 of the EU acquis Communautaire. This supports the governments in fulfilling their obligations within the United Nations as well as meeting the EU accession requirements.

UNODC, together with its government partners, international and regional organizations and civil society stakeholders, structures its work within the four Sub-Programmes of the RPSEE, all grounded in a gender-responsive, human rights-based approach:

Sub-Programme 1: Law enforcement and enhanced border security and related topics

Sub-Programme 2: Organized crime and countering illicit financial flows

Sub-Programme 3: Prevention of drug use and treatment and care of drug use disorders

Sub-Programme 4: Cross-Cutting Pillar: Strengthening research capacity, policy and monitoring

The consultant will support the implementation of the two regional projects, “From Illicit Financial Flows to Asset Recovery” and the “Regional Anti-Corruption and Illicit finance Roadmap”, both implemented under the umbrella of the UNODC Regional Programme for South Eastern Europe. The consultant will provide technical support to the project team in implementation of the agreed activities within the asset recovery portfolio for Kosovo (UNSCR 1244) as well as with the inception phase of the ACIF Roadmap project, ensuring that the overall technical direction of the project is maintained and flexibly adapted to meet the practical challenges faced during the implementation period.

Objectives of Assignment
Regional Program for South Eastern Europe – From Illicit Financial Flows to Asset Recovery has an objective to improve the overall security in the Western Balkans and beyond by combatting organised crime and terrorism. The specific objectives of the initiative are: (i) enhancing capacities to seize proceeds and instrumentalities of crime, with a view to ensure future confiscation; (ii) enhancing asset recovery capabilities, and pursuing proceeds and instrumentalities of crime through national coordination and regional and interregional cooperation; and (iii) enabling the collection of appropriate statistics on the different steps within the asset recovery process. The project supports further achievement of Sustainable Development Goals 5 (Gender Equality), 16 (Peace, Justice and Strong Institutions) and 17 (Partnerships for the Goals).

The project is in its second year of implementation, focusing on implementation of the activities that have been agreed in all 6 Western Balkan jurisdictions, focusing on further enhancement of asset recovery capabilities as set by the Asset Recovery Roadmap. In Kosovo (UNSCR 1244), the project will focus on capacity development of judges, prosecutors and other practitioners in asset recovery utilization, international cooperation and mutual legal assistance and development of targeted knowledge products to facilitate easier asset recovery processes internally.

The overall objective of the Regional Anti-Corruption and Illicit Finance Roadmap project is to support the implementation of the Roadmap (full text available on: https://www.unodc.org/documents/southeasterneurope//AC_and_Illicit_Finance_Roadmap_Full_25.06_PDF.pdf with the overall aim to fast-track the implementation of existing anti-corruption commitments, including those under the UNCAC, the GRECO evaluation recommendations, and relevant EU Directives in support of the achievement of the Sustainable Development Goals 5, 16 and 17 in the Western Balkans jurisdictions.

The implementation of the Regional Anti-Corruption and Illicit Finance Roadmap will result in the delivery of tangible improvements to the implementation of existing national anti-corruption/anti-illicit finance measures, and international standards and recommendations, including those from the UNCAC Implementation Review and Group of States against Corruption (GRECO) evaluation recommendations and the European Commission’s annual reports with respect to EU enlargement.

Initial baselining of the anti-corruption landscape in the Western Balkan jurisdictions was conducted during the development of the Roadmap through the consultation process held within all jurisdictions. It led to the conclusion that different levels of implementation of anti-corruption initiatives exist in the Western Balkan jurisdictions. The first activity of the Roadmap Secretariat will be to develop jurisdictional based action plans for implementation of the Roadmap. In establishing these action plans, the current level of implementation will be mapped in each jurisdiction for each thematic area and will define the approach in delivering support through this project. This project will also support the Western Balkan jurisdictions with transfer of knowledge, solutions, methodologies and direct support, as appropriate, among themselves. For these reasons, through this consultancy support will be provided to successful implementation of the Inception phase of the Project.

The consultant will plan, research, meet and consult with stakeholders and contribute to the data collection and data analysis which will inform and enhance implementation of both projects. The consultant will conduct other tasks in the area of general project support, as instructed by the Regional Advisor.

Duties and Responsibilities

Scope of workSpecific tasks to be performed by the consultant:

Under overall supervision of the UNODC Regional Adviser, and in cooperation with National Program Officer (NPO), the consultant will accomplish the following tasks to achieve the above-mentioned objectives:

Asset Recovery:

Analyze existing capacities and gaps in the asset recovery implementation, with a view to identifying key priority areas for activity implementation
Support the implementation and organization of capacity building activities in Kosovo (UNSCR 1244) in line with the agreed activities and needs of the stakeholders
Support other activities, as instructed by the NPO and/or Regional Adviser

ACIF Roadmap:

Review and map the existing anti-corruption initiatives and projects in Kosovo (UNSCR 1244) and the scope of assistance that is being provided to the authorities;
Examine the priorities and expectations of authorities in relation to the Roadmap and other anti-corruption related activities;
Assist in development of the action plan for the implementation of the Roadmap
Support other project activities related to the inception phase of the project, as instructed by NPO and/or Regional Advisor

Expected tangible and measurable output(s)/deliverable(s):

(Tangible and measurable outputs, objectives and targets of the work assignment, as well as specific activities to achieve the required outputs and targets. As per ST/AI/2013/4, Section 3.2 (a))

The consultant is expected to deliver the following tangible and measurable outputs:

Organize at least 2 meetings with relevant asset recovery stakeholders in Kosovo (UNSCR 1244) in order to further specify project activities and analyze gaps and needs in capacity building
Facilitate organization of at least two Asset Recovery capacity building project activities in Kosovo (UNSCR 1244)
Identify all relevant existing asset recovery and anti-corruption initiatives and projects in Kosovo (UNSCR 1244)
Develop inputs to the draft inception report on ACIF Roadmap; and
Conduct additional tasks as instructed by the NPO and/or Regional Advisor.

Payments will be made upon satisfactory completion and/or submission of outputs/deliverables. Please note that last payment must coincide with the end of the contract and must be identical to payment phases in the engagement of consultant/IC request.

6. Indicators to evaluate the consultant’s performance

All deliverables will have to be submitted electronically in English. All deliverables should meet the satisfaction of the supervisor-UNODC Regional Adviser according to the following indicators:

Quality of materials developed and drafted;
Technical competence;
Timely completion of assigned tasks.
All deliverables should be drafted in English

Criteria for selection of the Best Offer
Offers will be evaluated utilizing a combined Scoring method – where the qualifications and technical proposal will be weighted a max. of 70% and combined with the price offer which will be weighted a max of 30.

Additional Information

Individual Contract (IC) will be applicable for individual consultants applying in their own capacity.

Reimbursable Loan Agreement (RLA) will be applicable for applicants employed by any legal entity. Template of RLA with General Terms and Conditions can be found on: https://rs.undp.org/content/dam/serbia/downloads/PSU_Individual_Contract_Model_Reimbursable_Loan_Agreement.docx. In the case of engagement of Civil servants under IC contract modality a no-objection letter should be provided by the Government entity. The ‘no-objection’ letter must also state that the employer formally certifies that their employees are allowed to receive short-term consultancy assignment from another entity without being on “leave-without-pay” status (if applicable) and include any conditions and restrictions on granting such permission, if any. If the previous is not applicable ‘leave-without-pay’ confirmation should be submitted.

Engagement of Government Officials and Employees

Government Officials or Employees are civil servants of UN Member States. As such, if they will be engaged by UNDP under an IC which they will be signing in their individual capacity (i.e., engagement is not done through RLA signed by their government employer), the following conditions must be met prior to the award of contract:

(i) A “No-objection” letter in respect of the individual is received from the Government employing him/her, and;

(ii) The individual must provide an official documentation from his/her employer formally certifying his or her status as being on “official leave without pay” for the duration of the IC.

The above requirements are also applicable to Government-owned and controlled enterprises and well as other semi/partially or fully owned Government entities, whether or not the Government ownership is of majority or minority status.

UNDP recognizes the possibility that there are situations when the Government entity employing the individual that UNDP wishes to engage is one that allows its employees to receive external short-term consultancy assignments (including but not limited to research institutions, state-owned colleges/universities, etc.), whereby a status of “on-leave-without-pay” is not required. Under such circumstance, the individual entering into an IC with UNDP must still provide a “No-objection” letter from the Government employing him/her. The “no objection” letter required under (i) above must also state that the employer formally certifies that their employees are allowed to receive short-term consultancy assignment from another entity without being on “leave-without-pay” status and include any conditions and restrictions on granting such permission, if any. The said document may be obtained by, and put on record of, UNDP, in lieu of the document (ii) listed above.

Education:

An advanced university degree (Master’s degree or equivalent) in law, criminology or another related field, is required. A first level university degree in similar fields in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree;

Work experience:

A minimum of 5 years of experience in providing legal advice or technical assistance in corruption prevention.
Experience in anti-corruption is required;

Language:

Fluency in oral and written English and one of the official languages of Kosovo (UNSCR 1244) is required.
