About the programme

Legal Aid Clinic (LAC) is contributing to the implementation of access to justice programme“. The programme is led by International Law Development Organization (IDLO). The programme aims at “Strengthening the Social Contract through Access to Justice in Somaliland” and intends to foster the social contract in Somaliland by increasing the justice institutions’ legitimacy. The intervention’s overall goal builds on the assumption that improved access to adequate, timely, and fair justice services will increase citizens’ trust in relevant justice institutions, which will – in turn – encourage them to accept the State’s authority more easily. Thus, the increased legitimacy of justice institutions will translate into an improved social contract due to the enhanced capacity of the State to fulfil social expectations, ensure the protection of fundamental human rights and facilitate the peaceful resolution of disputes.

The overall goal will be reached through three (3) intermediate outcomes: (1) improved access to an alternative dispute resolution (ADR) mechanism and referral pathways, especially for vulnerable groups; (2) enhanced access to formal justice for vulnerable groups through holistic support to gender-based violence (GBV) survivors and affected communities; and (3) increased participation of citizens in Somaliland in accountability processes relating to the provision of security and justice. The programme adopts a Problem-Driven Iterative Adaptation (PDIA) approach.

About Legal Aid Clinic

The University if Hargeisa LAC is an autonomous statutory body established by the University of Hargeisa College of Law in 2002. The objective of the Legal Aid is to render or make available legal assistance to poor and disadvantaged persons in Somaliland as contemplated in the Constitution of the Republic of Somaliland, which guarantees every citizen to avoidable access to justice.

The legal aid clinic provides assistance to economically disadvantaged individuals within the boundaries of Somaliland. However, the legal clinic provides legal service on the matters that fall within the legal arena of criminal law civil law, human rights, and access to justice and child and women unit. Through this clinical work, students are expected to improve their skills in respect to interviewing, counseling, and mediation skills, and research writing skills.

Objective:

ADR center hotline consultant will support the operationalization of the ADR centers 24/7 hotline for users, victims and clients, providing First-Line Support, Counselling, Information and Referrals. The hotlines will be manned by ADR center staff members; who although they have the requisite background and training; also occupy other roles and responsibilities. Consequently, there is a need for developing hotline management protocol (Standard Operating Procedures (SOPs))to assist to operate the hotlines/helplines efficiently.

Function and Responsibilities:

Under the technical guidance of the Legal Aid Clinic’s (LAC) , the consultant will support the Damal programme in guaranteeing the provision of quality assurance monitoring of the recently established 920 ADR center hotline service. The advisor will:

• Develop internal Standard Operating Procedures (SOPs) for the hotline services
• Provide technical support and guidance to the LAC to aid the technically sound functioning of the 920 ADR center hotline service.
• Provide guidance in response to identified capacity-building needs within the Damal programme consortium and partners members, with regards to the 920 ADR center hotline service management and case information.
• Provide technical support to hotline operators’ (paralegals, community-based paralegals and social workers) provision of counselling, information, proper referrals to specialized supports, such us Police services, legal support services, medical, psychosocial support, and social services, to appropriately support victims with a victim centered approach, considering the validated referral pathway, protocols and SOP
• Provide technical to the paralegals, community-based paralegals and social workers guaranteeing quality services 24 hours a day, 7 days a week, including during weekend and holidays (ensuring that paralegals, community-based paralegals and social workers answer and respond appropriately to all phone calls received, answer messages received via phone)

Functional Competencies

To deliver these above-mentioned objectives and the associated scope of work, LAC is searching for a candidate with the following skills and experience:

1. Excellent knowledge and understanding of Justice and Legal Issues in Eastern regions of Somaliland. The programme is operating in complex environments to deliver a diverse portfolio of projects. The successful candidate will need to demonstrate a deep conceptual understanding of Justice and Legal Issues in Eastern regions of Somaliland.
2. Extensive experience and knowledge in Standard Operation Procedures (SOP). The Damal programme will be closely working with the Somaliland government to ensure that the Standard Operation Procedures (SOP) is conductive and relevant to hotline operations. The successful candidate will need to demonstrate extensive understanding, knowledge and experience in the development Standard Operation Procedures (SOP).
3. Excellent knowledge and experience of training, one on one monitoring and coaching others in Justice and Legal Issues, systems and activities.The successful candidate will need to demonstrate their potential to provide targeted support to Damal local IPs as well as specific partners staff members to build in-house ADR capacity and improve the coherence of ADR centers activities.

Candidate profile

Education and work experience

• Strong academic background in law, political science, public policy or related fields.
• At least seven years’ experience in the legal field
• Work experience in Somaliland and understanding of Somaliland legal context.
• Demonstrate seven years’ work experience in the legal field, access to justice, legal and policy framework, informal justice system and ADR or related field.
• Proven experience in drafting SOPs, reports.
• Robust knowledge of and expertise in gender issues and survivor-centered approaches to addressing GBV;
• Ability to work inclusively and collaboratively with a range of partners, including different GBV service providers for making referrals
• Sensitivity to and ability to work with marginalized populations.

Period of consultancy, scope, and the payment modality.

The consultant will be based in Hargeisa and he/she will travel to project target locations including Buroa, Erigavo and lasanod. This consultancy will be a 30 working days starting the date of contract signature. The incumbent will be paid in accordance with the terms of the services contract,  upon the completion of the service.
